1.2 By selecting the Company’s services, the Customer fully accepts the terms and conditions of all public documents. The same applies to interactions such as trade and investment transactions between the Customer and the Company, the use of informational materials, payments and transfers, etc. If the Customer does not comply with any condition of the public document package, they should cease all interactions with the Company. The Customer will stop all interactions with the Company, including financial transactions through the Company, if they find any condition of this Privacy Policy unacceptable for any reason.
1.3 The current Privacy Policy declares one of the most important principles followed by the Company in providing services to its Customers. The Company respects the privacy of each individual and legal entity, whether they are customers or others who wish to interact with the Company. The terms of this Privacy Policy apply equally to the Company's former, current, and future Customers. One of the most important priorities for the Company is the relationship between the Company and its Customers. The Company is committed to providing each Customer with the highest level of privacy and security.
1.4 The following key terms and definitions are used in this Privacy Policy:
1.4.1 Privacy (confidential information) refers to a legal right of an individual or legal entity to prevent the disclosure of private or personal information (data) or commercially classified information. In the relationship between the Company and the Customer, privacy means the Company’s commitment to ensure that it does not disclose or reveal the Customer’s information obtained during service provision.
1.4.2 The Customer's personal (private) information refers to details that characterize, identify, or verify the Customer, or reveal specific information about their personality, financial conditions, and preferences. A more detailed definition of this term can be found in the text of this Privacy Policy. This Privacy Policy defines the collection and protection of complete, accurate, and original information about the Customer, along with exceptional circumstances ensuring compliance with current legislation and the terms of this Privacy Policy.
2. PERSONAL INFORMATION
2.1 When the Customer applies for or maintains a live or demo account with the Company, the Company collects personal information for business purposes such as assessing the Customer's financial needs, processing the Customer's requests and opportunities, and informing the Customer about products and services that may be of interest. This helps to provide the Customer with efficient and high-quality services. This information may include the following types:
2.1.1 Registration Information – Information provided by the Customer in application forms and other documents (including electronic documents), such as name, surname, username, contact details (address, phone number, email, etc.), date of birth, occupation, assets, and income.
2.1.2 Transaction Information – Information about agreements between the Customer and the Company or its Affiliates, as well as communications between the Customer and the Company (either unilateral or bilateral). Examples include Customer account balances, trading (investment) activities, Customer requests, and responses from the Company, including posts or log files in messaging systems used by the Company.
2.1.3 Verification Information – Information required to verify the Customer's identity (or, in the case of a legal entity, the main contract). Examples include information from public records, such as passport or driver’s license, or from organizations not connected to the Company, like credit agencies and address offices. In accordance with Anti-Money Laundering policies, the Company collects the necessary information to prevent the laundering of money obtained from illegal activities and takes the required actions. In some cases, the Company may request a document that explains the source of funds.
2.1.4 Subscription Information – Information regarding subscriptions such as signals, alerts, news categories, and pricing.
2.2 The Company does not collect or store any customer credit/bank card details in its database.
2.3 The Company reserves the right to request additional information from the Customer if necessary for compliance with current legislation.
3. "COOKIES" POLICY
3.1 Cookies are small files containing information used by a web server (site) to track visitors. The Company may set and access cookies on Client computers to evaluate which ads and promotions attract users to the Company’s website. The Company (or any of its sections) may use cookies to assess the Customer's interest in its products and services and monitor the Customer's activities on the site.
4. SECURITY TECHNOLOGIES
4.1 The Company uses Secure Socket Layer (SSL) encryption technology to protect certain information sent by Customers. This technology ensures that the Customer's information is not intercepted by unauthorized individuals during transmission. The Company works to ensure that its web servers meet industry security standards. The Company also employs other security measures, such as firewalls, authentication systems (e.g., passwords and personal identification numbers), and access control mechanisms to monitor unauthorized access to systems and data.
4.2 The Company reserves the right to select technologies and data protection methods at its discretion and collaborate with contractors that it deems reliable in this area.
4.3 In line with the Payment Card Industry Data Security Standards Council’s recommendations, customer card details are protected using Transport Layer Security (TLS 1.2) and AES encryption with a 256-bit key length at the application layer.
5. SHARING INFORMATION WITH THE COMPANY'S AFFILIATES
5.1 The Company may share the personal information mentioned above with its affiliates for business purposes such as providing services to Customer accounts and informing the Customer about new products and services, as permitted by applicable law.
5.2 Affiliate partners may access Customer’s private information upon the Company’s request, and subject to the mandatory consent of the individual Customer. Any access by an affiliate partner to the Customer's personal information is logged in a manner that the Customer can view. This log includes: time, partner’s name, and the type of requested information.
6. SHARING INFORMATION WITH THIRD PARTIES
6.1 The Company does not disclose the Customer’s personal information to third parties, except in situations specified in this Privacy Policy. Third-party disclosures may include sharing information with non-affiliated partners who provide technical support services for Customer accounts or who provide professional, legal, or accounting advice to the Company to facilitate Customer agreements. Non-affiliated partners who assist the Company in providing services must maintain the confidentiality of this information and may only use it in the course of providing those services and solely for the purposes defined by the Company.
6.2 The Company may also disclose the Customer’s personal information to third parties in accordance with the Customer’s instructions or upon the Customer's explicit consent. The Company also assures Customers that it will never sell, temporarily use, or distribute their Personal Information under any circumstances.
7. LEGAL DISCLOSURE
7.1 Under limited circumstances, the Company may disclose the Customer’s personal information to third parties as required by applicable law or regulations. The Company may disclose personal information to regulatory authorities and law enforcement agencies as needed to comply with legal requests or to protect the Company’s rights or property.
7.2 Except as specified in this Privacy Policy, the Company will not use the Customer’s personal information for any purposes not disclosed at the time of disclosure or without the Company’s explicit consent.
8. OPTING OUT
8.1 The Customer may refuse to provide any Personal Information requested by the Company. However, failure to provide the required information may result in the Company being unable to open or maintain an account or provide further services to the Customer.
8.2 If the Customer does not want their personal information to be disclosed to third parties as described in this Privacy Policy, they should contact the Company using a specific communication form.
9. Amendments
9.1 The Company reserves the right to modify this Privacy Policy. Specifically, this may occur in cases where the current version does not directly or indirectly explain a certain situation or when a rule or law requiring such a modification or addition comes into effect.
9.2 Procedure for Changes:
9.2.1 In case of changes or additions, the Company will notify Customers through a notification on the official website and via an internal mail system.
9.2.2 Posting of the relevant notification on the Company’s website and sending messages via internal mail is considered sufficient notification of changes in the Privacy Policy, even if the Customer does not read or pay attention to the message.
9.2.3 The amended document will take effect 5 (five) full calendar days (120 hours) after the notification has been published on the Company’s website. Before this period, the notification is only for informational purposes.
9.2.4 The amended document will apply immediately to all registered accounts after it has been published (independent of previous accounts). The amended document will also apply to trading accounts created before the document comes into effect.
10. ACCEPTANCE OF NOTIFICATION TERMS BY THE CUSTOMER
10.1 By becoming a customer of the Company and actively using its services (including brokerage and information services), I accept the Privacy Policy outlined in this Notification.
10.2 During the use of any service by the Company, I accept all terms and conditions outlined in the public documents published by the Company, and in case of any dispute, I will immediately cease using the Company’s services.
